HydroCloud Service Agreement and Privacy Policy

Welcome to HydroCloud. Please read the following terms carefully. If you disagree with any term of this agreement, you may choose not to use HydroCloud. Upon successful registration, whether you access HydroCloud or publish any content (“Content”) on HydroCloud, you (“User”, including but not limited to browsing users, individual authors, organizations, etc.) shall be deemed to have fully accepted all terms of this agreement.

—— General Principles

When a user completes the registration process, it means the user has entered into an agreement with HydroCloud (including but not limited to websites, mobile applications and other platforms) regarding the services it provides, and voluntarily accepts all contents of this service agreement. Thereafter, the user shall not defend in any form on the ground that they have not read the contents of this service agreement. After successful registration, HydroCloud will assign each user a user account and corresponding password, which shall be kept by the user. The user shall bear legal responsibility for all activities and all content published under their user account.

1. Usage Rules

1.1 Users shall be responsible for the authenticity, legality and validity of their registration information on HydroCloud. Users shall not impersonate others or organizations in any way (including but not limited to using other persons’ or organizations’ names, avatars, nicknames); shall not use the name of others or organizations to publish any information; and shall not maliciously use registered accounts to mislead other users. If a user violates the foregoing, HydroCloud reserves the right to terminate services to such user, reclaim their account at any time, and the user shall independently bear all legal liabilities arising therefrom.

1.2 To better protect the legitimate rights and interests of individual users and organizations on HydroCloud, after successful registration, users may go to the “Profile” within HydroCloud to supplement and complete real personal information, including but not limited to name, phone number, address, and enterprise information.

1.3 HydroCloud is a community self-service system platform. Users can manage and operate their own devices on the platform, and end users can query, recharge, etc. Operators may also manage end-user information on the platform. As operators, they shall not disclose end-user privacy at will. Any violation shall result in independent legal liability borne by the operator, and the platform shall not bear any legal responsibility.

1.4 Users undertake not to use HydroCloud in any way to directly or indirectly engage in activities in violation of Chinese laws, regulations and social morality. HydroCloud reserves the right to delete content that violates the above commitments.

1.5 Users agree not to use the services provided by HydroCloud to create, publish, transmit or otherwise send information containing any of the following contents:
- Opposing the basic principles as determined by the Constitution;
- Endangering national security, disclosing state secrets, subverting state power, undermining national unity;
- Harming national honor and interests;
- Inciting ethnic hatred, ethnic discrimination, undermining ethnic unity;
- Undermining national religious policies, promoting cults and feudal superstitions;
- Spreading rumors, disturbing social order, undermining social stability;
- Spreading obscenity, pornography, gambling, violence, murder, terror or abetting crimes;
- Insulting or defaming others, infringing upon the legitimate rights and interests of others;
- Containing other contents restricted or prohibited by Chinese laws and regulations and other legally binding norms;
- Containing contents that HydroCloud deems inappropriate to display on HydroCloud.

1.6 HydroCloud reserves the right to review and supervise users’ use of HydroCloud. If a user violates any of the above provisions when using HydroCloud, HydroCloud or its authorized person has the right to require the user to correct or directly take all necessary measures to mitigate the impact of the user’s improper conduct.

2. Intellectual Property Rights

HydroCloud is a community automated sales and comprehensive service platform. We respect and encourage the content created and published by HydroCloud users, and promise to protect intellectual property rights as one of the basic principles of HydroCloud’s operation.

2.1 The copyright of all original articles, information, comments and other content published by users (including but not limited to operators, end users, etc.) on HydroCloud shall be owned by the users themselves. Users may authorize third parties to use them in any way without the consent of HydroCloud. However, if the information is edited, modified, translated, adapted or annotated by HydroCloud, users shall obtain HydroCloud’s consent before authorizing third parties to use it.

2.2 The logos, layout, typography, texts, pictures, graphics and other materials included in the network services provided by HydroCloud are protected by copyright, trademark laws and other relevant rights and laws and regulations. Without the consent of the relevant obligees (including HydroCloud and other original obligees), the above contents shall not be directly or indirectly published, used, rewritten or republished for the purpose of publication or use, or used for any other commercial purposes on any platform.

2.3 To promote the sharing and dissemination of information, users grant HydroCloud a free, irrevocable, non-exclusive license to use all content published by them on HydroCloud. HydroCloud may use such content on various forms of products and services of HydroCloud and its partners, including but not limited to websites and published applications or other Internet products.

2.4 If a third party intends to republish content published by users on HydroCloud outside HydroCloud for non-commercial purposes, it shall indicate the original author’s name at a prominent position at the beginning of the work, provide the original link, mark “Source: HydroCloud”, and shall not arbitrarily modify or deduct the content. If it is necessary to modify the content or use it for commercial purposes, the third party shall contact HydroCloud or the user to obtain separate authorization and use the content in the agreed manner.

2.5 HydroCloud provides users with the option of “Exclusive Authorization, No Reproduction”. Unless the original author’s separate authorization is obtained and HydroCloud is contacted by email, any third party shall not reproduce content marked “No Reproduction”, otherwise it shall be deemed as infringement.

2.6 When publishing creations or comments on HydroCloud, users shall guarantee that they are the copyright owners or have obtained legal authorization, and that the content will not infringe the legitimate rights and interests of any third party. If a third party raises an objection regarding copyright, HydroCloud reserves the right to rectify or delete the relevant content according to the actual situation, and has the right to pursue the user’s legal liability. The user shall bear full compensation liability for any losses caused to HydroCloud or any third party.

3. Infringement and Rights Protection Rules

3.1 Handling Principles
As a community self-service platform, HydroCloud will respect and protect the legitimate rights and interests of every user and operator to the greatest extent within the scope of responsibility. HydroCloud has not cooperated with any third-party individuals or organizations to carry out this business. All the following rules and procedures are subject to the response of HydroCloud’s official channels.

3.2 Scope of Acceptance
Accept infringement reports that infringe upon the legitimate rights and interests of individuals or organizations within HydroCloud, including but not limited to malicious pre-registration, impersonation of identity information, infringement of personal privacy, rumors and defamation, and commercial infringement.

3.3 Reporting Conditions
If an individual or organization finds content on HydroCloud that infringes upon its legitimate rights and interests, it may contact HydroCloud via email or phone. To ensure timely and effective handling of the problem, please be sure to submit true, valid, complete and clear supporting materials; otherwise HydroCloud will not accept them.

4. Disclaimer

4.1 As a community self-service comprehensive service platform, HydroCloud reserves the right but not the obligation to review all content posted by users.

4.2 For the information created and published by HydroCloud users, HydroCloud cannot guarantee its authenticity and accuracy, and publishing such information does not mean that HydroCloud confirms its description or endorses its views.

4.3 All information provided by HydroCloud is for users’ reference and communication only, and does not constitute commercial advice or other practical operational opinions.

4.4 HydroCloud does not warrant that the network services provided will definitely meet users’ needs, nor that the network services provided will not be interrupted. HydroCloud shall not be liable for any interruption of network services or other problems caused by force majeure or other causes beyond HydroCloud’s control, but promises to minimize the impact and losses caused to users.

4.5 Users acknowledge and agree that HydroCloud shall not be liable for any accidental disclosure of user data caused by force majeure or other causes beyond HydroCloud’s control (such as network security vulnerabilities, hacker attacks, etc.), but promises to minimize the impact and losses caused to users.

5. Amendment to the Agreement

5.1 In accordance with changes in relevant Internet laws, regulations and normative documents, or due to business adjustment and development needs, HydroCloud reserves the right to modify this service agreement and relevant agreements for each individual service by reasonable means such as issuing an announcement on the webpage when necessary. When users enjoy various services, they shall timely check and understand the modified contents of the relevant agreements, and consciously abide by this service agreement and other relevant agreements for individual services.

5.2 To the extent permitted by relevant laws and regulations, HydroCloud reserves the right of final interpretation of this user agreement.

6. Governing Law

6.1 The conclusion, implementation, interpretation of this agreement and dispute resolution shall be governed by the laws of China.

6.2 If any dispute arises between the parties regarding the content or implementation of this agreement, the parties shall try their best to resolve it through friendly negotiation. If negotiation fails, the dispute shall be submitted to the China International Economic and Trade Arbitration Commission for arbitration. The arbitration award shall be final and binding on both parties.

Privacy Policy

Beijing Heipitai Technology Co., Ltd. (“HydroCloud”, “we”, “us” or “our”) has always solemnly committed to protecting the privacy of users (“users” or “you”) who use HydroCloud’s products and services (collectively, the “HydroCloud Services”). When you use HydroCloud services, we may collect and use your relevant information.

This Privacy Policy applies to all HydroCloud services we provide. When you use any of our individual services, you agree to be bound by this Privacy Policy and the specific privacy information policy terms we issue in such individual services. When you use HydroCloud services, we may collect and summarize information such as users’ access channels and access sequences.

(2) Personally identifiable information:
When you use HydroCloud services, we may collect and summarize or ask you to provide personally identifiable information, such as personal identification (including ID card, passport, driver’s license, etc.); date of birth, native place, gender, hobbies, personal phone number, facial features; network identification information (including system account, IP address, email address and passwords related to the foregoing); personal property information (transaction records, balance, coupons, game redemption codes, bank card information, etc.); communication information; personal online records and log information (including website browsing records, software usage records, click records, operation logs, etc.); device information (including device model, device MAC address, operating system type, device settings); unique device identification code; location information (including travel information, precise positioning information, accommodation information, latitude and longitude, etc.).

(3) Account cancellation
Your HydroCloud service account may be cancelled or deleted if it meets the conditions stipulated in the service agreement of HydroCloud’s individual service and the provisions of relevant national laws and regulations.

(4) Change the scope of your authorization consent
You can always choose whether to disclose information. Some information is necessary for using HydroCloud services, but the provision of most other information is up to you.

6. Third-Party Services

HydroCloud services may link to social media or other services provided by third parties (including websites or other service forms). Such third-party social media or other services are operated by relevant third parties. Your use of such third-party services shall be governed by the third party’s own service terms and information protection statements, not this Privacy Policy. This Privacy Policy applies only to any information we collect, and we are not responsible for any third party’s use of the information provided by you.

7. Age Restriction

We recommend that any minor participating in online activities obtain the consent of their parents or legal guardians in advance. We will protect the relevant information of minors in accordance with the provisions of relevant national laws and regulations.
